Delaware | Guide to adult-use/hybrid licensee setup in Dutchie POS

Consult this guide to configure Dutchie POS for adult-use sales in Delaware.

Enable recreational customer type

To enable a recreational customer type in Dutchie Backoffice: 

  1. Go to Settings > Location.
  2. In the Point of Sale section, check Allow Rec Customers.
  3. Click Save.
  4. Go to Customers > Actions > Manage customer types.
  5. Set Recreational to Show.

Set Up recreational taxes

Create/Modify Tax Categories (if needed)

  1. Go to Settings > Taxes & compliance and select the Taxes tab.
  1. If you don't have a specific category for adult-use cannabis tax, add a new Tax Category (e.g., "DE Adult-Use Excise Tax").
  2. Give it a descriptive Name.

Create Tax Rate for Delaware Excise Tax

Delaware imposes a 15% excise tax on adult-use cannabis retail sales. Medical cannabis sales are exempt from this tax.

  1. In Settings > Taxes & compliance, on the Taxes tab.
  2. Click Add rate or modify an existing one.
  3. Enter a descriptive Name (e.g., "DE State Excise Tax - 15%").
  4. For Rate, enter 15 (for 15%).
  5. For Applies To, select Recreational (and ensure Medical is unchecked).
  6. For Tax Type, select Excise Tax.
  7. Ensure Applies to is set to cover all relevant cannabis product types.
  8. Decide if the tax is inclusive (built into the displayed price) or exclusive (added at checkout) and configure accordingly.
  9. Set the appropriate Start Date (e.g., August 1st, 2025, for adult-use sales).Tax configuration settings for DE State Excise Tax.
  10. Click Save.

Assign Tax Categories to Products

  1. Go to Products > Catalog.
  2. For each recreational cannabis product, assign the appropriate Tax Category (e.g., "DE Adult-Use Excise Tax"). This can be done individually or using Bulk actions > Bulk edit product details.
  3. Ensure medical-only products remain assigned to a Tax Exempt or equivalent category.

Configure purchase limits for recreational customers

Delaware's Adult-Use Purchase Limits are:

  • Up to one ounce of cannabis flower, OR
  • 12 grams of concentrated cannabis, OR
  • Cannabis products with 750 milligrams or fewer of delta-9 THC.

Set your flower equivalencies for non-flower products

To accurately track against the state's purchase limits, you must set flower equivalencies for your non-flower products in Dutchie POS.

Understanding flower equivalencies

Per OMC, one ounce of flower (28.35 grams) is equivalent to:

  • 12 grams of concentrate OR
  • 750 mg of THC in cannabis products.

Setting concentrate flower equivalency

  • Calculation: 28.35 grams of flower = 12 grams of concentrate.
    • This means one gram of concentrate should have a 2.36 flower equivalency (28.35 / 12 = 2.3625).
  • Example: If a vape cartridge is 1.5 grams, its flower equivalency should be 3.54 (2.36 * 1.5). Enter 3.54 in the flower equivalency field for that product.

Setting edible flower equivalency

  • Calculation: 28.35 grams of flower = 750 mg of THC (or 0.75 grams of THC).
    • This means one gram of THC (1000 mg of THC) should have a 37.8 flower equivalency (28.35 / 0.75 = 37.8).
  • Example: If an edible contains 1000 mg THC, you would enter 37.8 in the flower equivalency field for that product.

Flower products

  • Flower products do not require a flower equivalency. Instead, use the "grams/concentration" field. The flower product's total weight should be entered in this field (always in grams).

Set products as medical-only

If you have products that are restricted to medical patients and caregivers (e.g., edibles over 750mg THC), you must configure them in Dutchie POS to prevent sales to adult-use consumers.

  • Configuration: For these specific products, ensure they are configured in Dutchie POS to be available only for medical patients and caregivers. To configure, go to Catalog > Available For > Deselect the non-medical consumer types.

Update label templates for adult use sales

This section addresses the requirements for updating your label templates to comply with Delaware's adult-use labeling regulations.

Update default label settings

If you use Dutchie's label template or create your own new label template, remember to update the default label templates for your registers:

  1. In the Backoffice, go to Settings > Devices.
  2. Select a register.
  3. From the Default label dropdown, select your new label template.
  4. Click Save.
  5. Repeat for each register at your location.

Action: Review and update all label templates to meet Delaware's adult-use packaging and labeling requirements set forth by the Office of the Marijuana Commissioner (OMC).
