Internal and external Dutchie compliance documentation has been prepared for informational purposes only, and is not intended to provide, and should not be relied on for, tax, legal or compliance advice. Dutchie provides tools that assist in compliance in many optional configurations. Merchants should consult their own tax, legal and compliance advisors to determine how best to configure Dutchie compliance settings and, in general, how best to operate within the cannabis industry.

Refer to Set tax rates and purchase limits and set up a 9% tax on recreational cannabis products and a 6% local tax.

For the 9% recreational cannabis tax, be sure to select Tax type: Sales.

If the tax type is set to None, required tax data will not be reported to Metrc.

City and county taxes are only used when applicable. See definitions below.

  • City tax: Local business tax imposed by a local jurisdiction, when applicable.
  • County tax: County tax imposed by a county, when applicable.
  • Sales tax: 9% sales and use tax for the sale of cannabis to adult-use consumers
  • Excise tax: Maryland is not using this field at this time.

Walkthrough: Set up tax categories in Dutchie POS

In Dutchie E-Commerce

If you use Dutchie E-Commerce, you will also need to configure your taxes there.

Walkthroughs:

  1. From Taxes & Compliance you can create and set tax rates for different types of products and purchase limits for different types of customers.
  2. After creating the new tax rate, you will want the rate to apply to select customer types (Recreationa). Medical taxes will stay the same

Configure purchase limits for recreational customers

Set up purchase limit categories using equivalencies and product categories:

  • Cannabis (Flower) 1.5 oz
  • Concentrate (Vapes are the only concentrate product to sell to recreational customers) 12g or Cannabis Products containing 750mg
  • This is based on a separate limit for all categories.

Walkthrough: Configure recreational purchase limits in Maryland

By using our updated purchase limit recommendations, a customer would be prevented from purchasing 100% of their allotment in a single category.

If you prefer to allow customers to purchase 100% of a purchase category, you can set the purchase limits to each category accordingly but your team will be responsible for ensuring that purchase limits are enforced as our system will not prevent sales of other products once a product category reaches 100%.

Add/verify flower equivalencies

In order to calculate the correct purchase limits for your recreational customer at the point of sale you will need to configure flower equivalencies at both the product and inventory level.

Flower equivalencies will be used to calculate recreational customer purchase limits, unlike medical customers who use Metrc allotments.

  • 100mg of edibles = 5.67 g Flower
  • 10mg of edibles = .567 g Flower
  • 1g of concentrate (Vape) = 3.54 g of flower
  • .5g of concentrate (Vape) = 1.77g Flower

Restrict certain products to medical customers only

All concentrates (except vape cartridges) such as live rosin, shatter, batter, etc., and any products containing over 100 mg or over 10 mg per serving (such as edibles with more than 100 mg) are restricted to medical customers only in the state of Maryland.

To make sure these products can only be sold to medical customers:

  1. Create separate products and/or product categories for medical cannabis and adult-use cannabis. For example, Blue Dream-3.5g-MED and Blue Dream-3.5g-AU; or Concentrates - MED and Concentrates - REC.
  2. Use the Available for dropdown to select the medical customer type(s) that can purchase the product or category of products.
    • Product-level settings will override category-level settings.
    • However, if you change your Available for selections for an existing product category, this will also update customer-type restrictions for all assigned products.
